General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (hereinafter referred to as "Terms") apply to all orders placed via our online store at www.obliquedecor@gmx.de by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. A business is a natural or legal person or a partnership with legal capacity acting in the exercise of its trade or profession when concluding a contract.

3. Conclusion of Contract

By placing products in the online shop, we make a binding offer to conclude a contract for these products. You may place products in the shopping cart without obligation and correct your entries at any time before submitting your binding order.

The contract is concluded when you click the order button ("Buy now" or similar) and receive a confirmation email.

4. Language of Contract

The language available for the conclusion of the contract is English. Optional translations are provided for convenience only and are not legally binding.

5. Prices and Payment

All prices are stated in EUR (or other selected currencies) and include applicable VAT (if applicable). Shipping costs may apply and are displayed before order completion.

We accept the following payment methods:

  • PayPal

  • Klarna

  • Shopify Payments

  • Other options shown at checkout

Payment is due immediately upon conclusion of the contract.

6. Shipping and Delivery

We ship worldwide using trusted shipping partners. Shipping times and delivery estimates are displayed during checkout.

Please note: In a dropshipping model, items may be shipped directly from our partners. Customs duties, import taxes, or fees may apply in the recipient's country. These are the responsibility of the customer.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal as outlined in our [Right of Withdrawal Policy].

8. Retention of Title

Goods remain our property until full payment has been received.

9. Liability

We shall be liable without limitation for damages caused intentionally or by gross negligence. For slight negligence, we are only liable for breach of material contractual obligations (cardinal duties), limited to foreseeable damage.

Liability for loss of profits is excluded. Statutory liability under the German Product Liability Act remains unaffected.

10. Warranty (Statutory Guarantee)

The statutory warranty rights under German law apply. The warranty period for used goods is limited to one year.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

13. Final Provisions

Should any provision of these Terms be invalid, the remainder of the contract shall remain unaffected.
